We reserve the right to modify, suspend, or discontinue any part of our Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5.3 Service Availability

While we strive to ensure that our Service is available at all times, we do not guarantee that the Service will be available at all times. We are not liable for any downtime or service unavailability, including those due to technical issues, maintenance, or factors beyond our control.

6. Payments & Refunds

6.1 Pricing

The prices for our services are listed on our website or will be provided to you during the enrollment process. All prices are in Euros (€) unless otherwise specified. We reserve the right to change our prices at any time, but changes will not affect services you have already purchased.

6.2 Payment Terms

Payment for our services must be made in advance. We accept various payment methods as indicated on our website. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the payment information you provide is accurate and complete.

6.3 Refunds

Our refund policy is as follows:

• Full refunds are available within 7 days of purchase if you have not accessed more than 10% of the course materials.
• Partial refunds may be available within 14 days of purchase, at our discretion, based on the amount of the course you have completed.
• No refunds are available after 14 days from the date of purchase or if you have completed more than 30% of the course.
• Special circumstances may be considered on a case-by-case basis.

6.4 Taxes

Prices listed do not include applicable taxes. Any taxes that we are required to collect will be added to your total amount due at checkout.

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by FastTrack English and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 7.2 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial purposes. This license does not include the right to:

• Attempt to decompile or reverse engineer any software contained on the Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FASTTRACK ENGLISH, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

9.3 Cap on Liability

IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED THE GREATER OF €100 OR THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE LAST 12 MONTHS.

10. Termination

10.1 Termination by You

You may terminate your use of the Service at any time by ceasing to use the Service. If you have an account, you may also terminate your account by following the instructions on our website. Termination of your account may not necessarily cancel any ongoing service subscriptions or entitle you to a refund.

10.2 Termination by Us

We may terminate or suspend your access to all or part of the Service, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms, applicable laws, or is harmful to the interests of another user, a third party, or us.

10.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Dispute Resolution

11.1 Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without giving effect to any choice or conflict of law provision or rule.

11.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the Cyprus Arbitration and Mediation Centre. The arbitration shall take place in Limassol, Cyprus, in the English language, and the arbitral decision may be enforced in any court.

11.3 Waiver of Class Actions

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

11.4 Exceptions

Nothing in these Terms will prevent either party from seeking injunctive or other equitable relief from the courts for matters related to intellectual property rights or unauthorized access to the Service.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and us concerning the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and us with respect to the Service.

12.2 Waiver

No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

12.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions of the Terms will continue in full force and effect.

12.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign or transfer these Terms, at our sole discretion, without restriction.
